ZSA Policy on Waiving or Postponement for Payment of Production Royalties

Growers can apply for waiving of production royalties in a year they experience a total loss of or damage to crop due to "Acts of God". "Acts of God" are defined as damage/total loss of fruit due to hail, wind or snow storms, flooding, lightning, fire or a ministerial declaration of a disaster area. A small crop or bad quality fruit do not qualify for waiving of production royalties. Growers must learn to insure their crop against failure to pay production royalties.

If a Grower does not have a crop in third leave due to growing/horticultural problems after planting, the Grower may apply for postponement for the payment of production royalties.

Procedure for waiving:

  • Grower must contact ZSA and file a written application with a complete motivation for possible waiving the production royalties within ten (10) working days after the incident occurred.
  • Zaiger SA will contact Grower for a date for an "on-site" inspection and report the pending waiver within two (2) working days after receipt of the waiver application.
  • The "on-site" inspection by Zaiger SA representatives will take place within seven (7) working days after confirmation of inspection.
  • The final decision by Zaiger SA will be communicated in writing to the Grower and Zaiger Genectics within two (2) working days after the inspection date.

Procedure for postponement of production royalties:

  • Grower must contact ZSA and file a written application with a complete motivation for possible postponement of production royalties during the bloom season.
  • Zaiger SA will contact Grower for a date for an "on-site" inspection and report the pending postponement within two (2) working days after receipt of the postponement application.

  • The final decision by Zaiger SA will be communicated in writing to the Grower and Zaiger Genectics within two (2) working days after the inspection date.
